COVERAGE OF OUR PRODUCTS
The use of this web platform, as well as any transaction carried out through it, is considered to be conducted in Spain and, therefore, is subject to the current Spanish laws and regulations, without prejudice to the applicable legislation according to the consumer's status.
These General Terms and Conditions are intended to establish the regulatory framework for the conclusion of the Contract. These conditions will be supplemented, where appropriate, by the corresponding Specific Terms and Conditions.
As a Consumer, the Contract entered into is governed by Royal Legislative Decree 1/2007 of No-vember 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter referred to as TRLGDCU).
PROCEDURE FOR CONTRACTING. HOW CAN I BUY ONLINE?
In order for you to access the products offered by LIGHTINGSPAIN and make a purchase, you will need to provide your personal data voluntarily and freely. It is informed that, in accordance with the requirements of art. 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow the following steps:
Click on the product you wish to select and press the "Add to Cart" button. (The cart is located at the top right of the page).
If you wish to continue shopping, click the "Continue shopping" button; otherwise, click "Proceed to Checkout".
Once you have selected the products you wish to purchase, as well as the number of units, color configuration, material, and light source (if applicable), you can either log in or create an account to complete the order, or if you prefer, make your purchase without registration, as a guest. Click on "Proceed to Checkout".
Next, you will need to provide us with your personal data. On the same screen, you have basic information on data protection, as well as access to the second layer of information (detailed information on the privacy policy).

It is important to note that once the transport company takes charge of the product, any requests for changes related to the delivery must be made directly with the transport company, using the tracking number provided. Data rectification in this context will be subject to the criteria of the transport com-pany.
Also, please note that for security reasons, if you choose PayPal as the payment method, once the order is placed, it will not be allowed to make any changes to the shipping address.

The products showcased on our website are carefully selected from our collection. We have paid special attention to accurately display the colors and features of our products. However, due to var-iations in monitor quality or resolution, it is important for users to carefully review the product de-scription on the purchase page, as it is not subject to such contingencies.
Additionally, we will indicate the availability of the product for more complete information. In the event of an error where a product is shown as available but is not after purchase, LIGHTINGSPAIN will inform the user of this situation according to our "RETURNS POLICY - Out of Stock" section.
PRICE INFORMATION
The price of each product will be as indicated on our website at the time of purchase, and they will be expressed in Euro (€). Unless stated otherwise, product prices displayed on our website include legally applicable taxes (Spanish VAT).
For the rest of Europe, the VAT percentage corresponding to the country of destination within the European Union (EU) is applied.

It is important to note that prices may change at any time, although such modification will not affect orders that have already been placed.

PROMOTION OF SALES

In the case of items with a reduced price, the previous price will be shown alongside the reduced price, unless it concerns items put on sale for the first time.
If the advertised sales do not include the information stated in the previous paragraphs, it will be understood, as indicated in these conditions and in this section, that the price may vary according to demand, not responding to a specific period or promotion. In other words, they will be recommended retail prices (RRP).
In the case of sales with a gift or incentive, this may be delivered within the period determined by the sale, not exceeding the deadline established in each Autonomous Community, which in any case will not be longer than three months from the expiration date of the promotion.

CUSTOMS INFORMATION
If the delivery address for the product is outside the EU, you may be required to pay import duties and taxes, which will be charged to you when the package reaches its destination. Any additional amount due to customs clearance will be your responsibility. As an importer, you must comply with all applicable laws and regulations in the country where you receive the order. Please note that international shipments are subject to inspection and opening by customs authorities.
ORDERS OUTSIDE THE EUROPEAN UNION
To deduct VAT from international invoices, it is essential to provide the National Identity Document or Passport number.
Shipping costs, applicable taxes, and other surcharges and fees will be itemized at the time of purchase (payment screen), so the user can know exactly what the final price of the product is and how it is composed.
It is possible to estimate and charge a deposit for import duties during the order processing. These funds will be used to pay import taxes to the appropriate authorities when your order has arrived in the destination country.
The estimated amount of the import tax will appear on the summary page of your order. If this amount does not appear in your order summary, customs charges will be borne by the recipient.
OFFER AND ACCEPTANCE
The contracting procedure and pre-contractual information are there in Spanish or English. This is the language that will be used to carry out the contracting. In case it can be carried out in another language, it will be indicated before starting the contracting procedure.
PAYMENT METHODS INFORMATION
Payment for the price through the website is made at the time of purchase, and LIGHTINGSPAIN will send you a confirmation email of the purchase made, informing you of the expected date for the receipt of the product.
LIGHTINGSPAIN declares that it does not have access to, nor does it store sensitive data related to the User's payment method, except those strictly necessary for payment management. Only the corresponding financial institution processing the payment has access to this data for payment processing. Once the purchase process is completed, an electronic document is generated, formalizing the contract, which the user can print.
LIGHTINGSPAIN reserves the right to cancel orders in accordance with these conditions. You can consult the cancellation reasons in the specific section that regulates them.
Payment methods available
Payment for the products offered by the entity can be made through:

If your payment method is a bank card, by clicking on "Buy and proceed to payment," you confirm that the credit card is yours. If you receive a notification that your card has been declined and you have verified that the card has not expired and that the information number associated with your card does not contain any errors, you must first contact your bank to find out the reason for the rejection or lack of authorization. Through the financial institution "SEQURA," available exclusively in Spain, you can defer your payments in installments of 3, 6 or 12 months, starting payment in the same month. Conditions of financing.
Additionally, our establishment maintains commercial relationships with "PayPal," allowing our customers to defer payment of their purchases for a period of three months free of charges with the first payment being made in the same day of purchase. In case you exercise your right of withdrawal within the fourteen days from the date of acquisition of a product through LIGHTINGSPAIN, please note that exercising this right will automatically lead to the termination of the credit contract without imposing any penalty on the consumer, in accordance with Article 77 of Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users, as well as other complementary regulations.
Once the order is placed, the company will confirm your order within twentyfour hours (24 hours) following your request. These General Terms and Conditions of Contract will remain on this website and must be accepted by you before making payment.
How to pay via bank transfer
If you have chosen bank transfer as the payment method, you have a maximum of 7 business days to make it. The order will begin to be processed once the company has confirmation of the deposit.
If, after the 7 business days, we have not received the deposit, we will proceed to cancel the order.
What data should I use to make the bank transfer?

Is it safe to enter my credit card details on the website?

My card has been declined, what can I do?
If you receive a notification that your card has been declined, you should first contact your bank to find out the reason. However, this circumstance may arise for several reasons:
The most common reasons for a payment being declined are related to payment security policies. When making a payment through a secure payment gateway, the system will automatically verify that the card is enabled for Secure Electronic Commerce. Next, it will connect with the financial institution that issued the card, which will request the buyer to authorize the transaction using a personal authentication code. The transaction will only be carried out if the issuing bank of the credit card confirms the authentication code, and the charge will then be made to the card. Otherwise, the transaction will be declined.
The card may be expired. Check that your card has not exceeded the expiration date.
Credit limits or fund retention. It's possible that the card's limit for purchases has been reached.
Incorrectly entered data. Review that you have filled in all the necessary fields with the correct information.
In any case, your bank is the only entity that can provide you with the exact reason why a payment has been declined.
My card has been used fraudulently, what should I do?
You should notify LIGHTINGSPAIN via email or phone of any unauthorized or fraudulent charges on the card used for purchases on the website, as soon as possible, so that LIGHTINGSPAIN can take appropriate action.
INVOICE INFORMATION
The company generates invoices in electronic format provided you authorize it at the final moment of purchase. You can request it later through your user area if you are a subscriber to any of our company's products or services, or by writing to the email address provided in these conditions.
The invoice will be issued in the name of the natural or legal person placing the order, so you must ensure that the correct and complete buyer's information is provided.
No subsequent changes will be possible, except in cases of obvious errors in the provided data. In such cases, the user can request correction of the invoice within a period of 15 busi-ness days from its issuance.
LIGHTINGSPAIN advises that, to preserve data confidentiality, duplicate invoices will only be issued to the contract holder. No duplicates will be issued to third parties.
SHIPPING POLICY
Delivery time
The delivery time depends on the product being acquired. Not all products are in stock, as some are made to order. In any case, we will indicate the estimated delivery time on the product page before you begin the purchase process. If, for any reason, the order cannot be delivered, we will notify you as soon as possible.
It is important to note that all mentioned deadlines are in business days and are subject to payment confirmation according to the selected method. In case of any delay in delivery, we commit to in-forming you without delay.
We inform you that product deliveries are not made on Saturdays, Sundays, national, regional, or local holidays.
Delivery location
LIGHTINGSPAIN undertakes to deliver the product in perfect condition to the address indicated by you, which must be within Spain (including the Balearic Islands), as well as in the rest of the Euro-pean Union. To optimize the delivery process, the address provided must be one where delivery can be made during regular business hours.
LIGHTINGSPAIN assumes no responsibility when the product delivery cannot be made due to false, inaccurate, or incomplete data provided by the user, or when delivery cannot be made due to rea-sons beyond the shipping company, such as the absence of the recipient. In these cases, delivery retries will be coordinated, or pickup alternatives will be provided where possible.
For orders in the Canary Islands, Ceuta, and Melilla, as well as outside the European Union, they will be made only by quotation. We will calculate the applicable taxes and transportation. Transfer of risk and ownership
Delivery is considered made from the moment the product has been made available to the User or a third party indicated by him (other than the carrier) at the indicated delivery location. The risk of the products (including loss, damage, or theft) will be transferred to the User from the moment the product/products have been made available to him. However, if it is the consumer who arranges for the transport of the goods or if the carrier chosen is not among those proposed by the entrepreneur, the risk will be transferred to the consumer with the delivery of the goods to the carrier, without prejudice to his rights against it.
Delivery issues
If there is any discrepancy or visible issue with the order at the time of delivery, we recommend that you do not accept the delivery and that you record this on the delivery note or the document used by the carrier. If the order is accepted with significant damage or defects that are clearly visible, there may be difficulties in processing a return.
If, upon receipt of the package, you notice serious damage to the outer packaging, we strongly recommend that you refuse the delivery. Before signing for receipt of the package, please take a moment to open it and check that all items in your order are present and in good condition. If you detect dents, scuffs, impacts, water marks, missing package numbers, among other issues, it is very im-portant that, depending on the extent of the damage, you either refuse the order and inform the delivery person, or, if the damage is superficial, request that it be noted on the delivery slip. This will serve as proof that the shipment arrived in apparently poor condition.
Please take photographs of the condition in which the order is delivered and contact the LIGHTINGSPAIN Customer Service Department via email at [email protected], providing your personal details, order number, a detailed description of the discrepancy or issue, and photographs of the product, the outer packaging, the inner packaging, and the shipping label.
If damage is not apparent with the box closed, but upon opening the package its contents are damaged, or if you detect missing items, you must notify us within a maximum period of 24 hours from receipt of the order. In the case of deliveries made without prior notice, this period will begin from the moment you open the box and detect the issue. If notification is not made within this timeframe, the claim will not be accepted.
In the meantime, we also recommend informing the transport company of the incident so that they may initiate the corresponding logistics investigation in a timely manner.
Please be advised that, on certain occasions, transport companies have their own conditions and may exclude delivery of orders to properties without an elevator or under conditions that excessively hinder delivery. If you reside at a property with such characteristics, we kindly ask that you in-form us in advance so that we may coordinate with the transport company and seek the best possible solution.
Sale without installation and liability
In the context of transactions carried out by the entity LIGHTINGSPAIN, it should be unequivocally stated that the lighting products marketed by this company are offered exclusively as individual units, without any associated installation service, assistance, or provision of installation services. Conse-quently, LIGHTINGSPAIN disclaims all liability for any damage, loss, or other costs that may arise as a result of the installation of products purchased through its commercial channels.
LIGHTINGSPAIN assumes no responsibility whatsoever for expenses related to the installation, re-moval, or any other disbursement or charge connected with the assembly or mounting of the prod-ucts sold. It is hereby stated that, in accordance with applicable regulations, the costs and obligations arising from such installation services shall remain the sole responsibility of the purchaser or of third parties contracted for such purpose.
In the event of any claim or issue concerning the quality or condition of the purchased products that may require return, repair, or replacement, the terms and conditions set out in our Warranty Policy shall apply.
The aforementioned LIGHTINGSPAIN warranty policy establishes the specific procedures and con-ditions under which requests for repair, replacement, or return of defective products will be pro-cessed, safeguarding customers’ rights and expectations within the applicable legal framework.
RETURN POLICY
Right of withdrawal
In accordance with the provisions of Article 102 of the Spanish General Law for the Defence of Consumers and Users (LGDCU), you shall have the right to withdraw from the transaction within a period of fourteen (14) calendar days, without the need to provide any reason. For this purpose, we make the following document available to you for download here.
In such case, pursuant to Article 108.1, second paragraph, of the LGDCU, the shipping costs arising from the return shall be borne by you.
In the event of withdrawal, return shipping costs shall be subject to a fixed fee of €12 for shipments within mainland Spain and €19 for shipments to the Balearic Islands. These costs shall not apply when the return is due to a defective product or an error attributable to LIGHTINGSPAIN.
For other countries, return shipping costs will be the responsibility of the customer, Returns are not free of charge; the customer assumes the cost of return transport. LIGHTINGSPAIN facilitates the transport management, but passes the cost on to the customer. This cost is deducted from the amount of the return.
How to proceed with a product return?

You may choose to return the product at your own expense; however, for your convenience, "LIGHTINGSPAIN" offers the option of collecting the product by arranging the carrier responsible for such collection. The collection period will depend on the carrier and will always take place on business days.
Under no circumstances will we accept returns sent with carriage due (cash on delivery for shipping costs).
Once we have verified that the products you return meet all the specifications of the Returns Policy, we will send you an email informing you that the return has been accepted.

Regardless of the payment method used, the refund will be initiated as soon as possible and, in any event, within a period of fourteen (14) days following receipt of the product at our warehouses. In the event that payment was made by bank transfer, you must provide a bank account number in the return form in order for us to process the refund.
However, some of the products offered by LIGHTINGSPAIN fall within the exceptions to this right, as provided for in Article 103 of the Spanish General Law for the Defence of Consumers and Users (LGDCU):
(c) The supply of goods made to the consumer’s specifications or clearly personalized.
For this reason, once your order has been processed and shipped, you will not be entitled to ex-ercise the right of withdrawal.
LEGAL WARRANTY
The User may exercise the legal warranty of THREE YEARS for products or services in accordance with current regulations on consumer product warranties, as established in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws. In addition, LIGHTINGSPAIN undertakes to maintain the availability of repair parts and adequate technical service for a period of 10 years from the date the product ceases to be manufactured.
To use the warranty, it is advisable to keep some proof of purchase.
UNDERAGE USERS
Access to and purchase of products on this website are reserved exclusively for persons over eighteen (18) years of age, in accordance with Article 1263 of the Spanish Civil Code. If a minor wishes to purchase our products, the transaction must be completed by his or her parent or legal guardian, who shall assume all contractual obligations and responsibility for the accuracy of the information provided. Parents or legal guardians are urged to supervise minors’ online activities and to ensure that no purchases are made without proper authorization. LIGHTINGSPAIN shall not be liable for purchases made by minors without the authorization of their legal representatives, nor for any inaccurate information that such minors may provide.
CONFLICT RESOLUTION
Applicable law and jurisdiction
The relationship between LIGHTINGSPAIN and the Consumer/User shall be governed by current Spanish legislation. In accordance with Article 90.2 of the TRLGDCU, all disputes and claims arising from this legal notice shall be resolved by the Courts and Tribunals of the consumer's domicile.
